A settlement has been proposed in this class action lawsuit alleging that the Defendants breached their fiduciary duties under the Employee Income Retirement Securities Act of 1974, commonly referred to as ERISA, in connection with the Plan’s investment in and holdings of Boston Scientific stock.

This settlement involves who were participants, beneficiaries or alternate payees of the Boston Scientific Corporation 401(k) Retirement Savings Plan (the “Plan”) at any time between May 7, 2004 and January 26, 2006, inclusive, and on whose behalf the Plan held Boston Scientific stock during that time.
