ON JULY 29, 2011 THE ALAMEDA COUNTY COURT ENTERED A THIRD AMENDED JUDGMENT AGAINST RICHARD THOMAS and his business, ENVIRONMENT AND LAND MANAGEMENT, INC. (ELM) (collectively “Defendants”), in favor of a class of his former tenants, in the amount of $205,526.36 against both defendants, plus $1,000,000 against Richard Thomas, plus interest at 10% from December 30, 2008, plus attorneys’ fees and costs.
If your name was on a lease with Richard Thomas or ELM and you did not get your security deposit refunded – in whole or in part – and you were either paid up on your rent or left owing less rent than your security deposit – you have a right to a share of the damages that have been won in this lawsuit, if this happened to you between August 15, 1999 and August 23, 2007.
The exact definition of the class was set by the court, as follows:
“Those former tenants of defendants named in a written lease who moved out of a rental unit owned by Defendants in Alameda County between August 15, 1999 and August 23, 2007 and who did not receive a refund of all or any part of a security deposit paid by them as to whom defendants’ records do not reflect claims for unpaid rent or late fees that exceed the amount of the security deposit paid by or on behalf of the former tenant”.
The damages to be distributed to class members may be as much as five times the amount of the security deposit that was not returned to you when you moved out of a Defendant’s property.
If you fall within the above description and believe you are a member of the class,
you may apply to receive a portion of the damages award by filling out a simple claim form
which is available from this website. The court has ordered a Plan of Distribution which explains in
detail how the damages will be distributed. A copy of that Plan is also available here.
