STETSON v. WEST PUBLISHING CORP.
BAR/BRI CLASS ACTION SETTLEMENT WEBSITE
If you paid for a BAR/BRI full-service bar review course from August 1, 2006, through
and including March 21, 2011, you could get a cash payment from a class action settlement.
There is a proposed settlement in a class action lawsuit against West Publishing
Corporation and Kaplan, Inc. (Stetson, et al. v. West Publishing Corporation, et
al., Central District of California Case No. CV-08-00810 R). This settlement supersedes
the prior proposed settlement of which you may have received a notice in April 2011.
The lawsuit alleges that BAR/BRI and Kaplan violated federal antitrust laws by agreeing
to limit competition in the market for full-service bar review courses. West was
the owner of BAR/BRI during the relevant period.
What does the settlement provide? Defendants have agreed to pay the total sum of
$9,500,000 (the "Settlement Fund"). After deductions for Class Counsel's attorney's
fees and costs and other amounts associated with the settlement as approved by the
Court, the remainder of the Settlement Fund will be distributed to Class Members
who submit timely claims in proportion to the amount that they paid for relevant
BAR/BRI courses.
What are my options? To receive a portion of the Settlement Fund, you must submit
a Claim Form, postmarked or submitted online by July 8, 2013. Instead of submitting
a Claim Form, you may submit a request to exclude yourself from the Class by the
same deadline, in which case you will not receive any portion of the Settlement
Fund, but you will preserve your right to bring your own suit for the conduct alleged
in the lawsuit. If you do nothing, you will remain in the Class but will not receive
any money. If you do not exclude yourself from the Class, you may also object to
the settlement and/or Class Counsel's request for fees and expenses and other proposed
deductions from the Settlement Fund. To do so, you must mail a written objection
to the Claims Administrator postmarked by July 8, 2013.
The Court will consider any objections and determine whether the proposed settlement
should be approved at a hearing in Los Angeles on August 19, 2013, at 10:00 a.m.
You may, but are not required to, appear at the hearing or hire an attorney to appear
for you, at your own expense.
The foregoing is only a short summary of the relevant information. Please check
this website for more details, including the settlement-related documents, and to
use the Claim ID and PIN assigned to you to view the amounts that West's records
show you paid for relevant BAR/BRI courses.
